Cape Girardeau council vacates blanket easement, approves Starview Grove plat

The Cape Girardeau City Council on Monday approved two land-use measures tied to the Starview Grove development, voting to vacate a portion of a city utility blanket easement and to approve the project's record plat.
The council opened a public hearing before taking up the ordinances and heard brief remarks from an applicant who said the developer had obtained the other required easements and was awaiting council approval of the city vacation. "I think we're vacating that there and we got all the other necessary easements and everything you know, to the city waiting for your approval," the applicant said.
City staff described the street-level issue to council members. "The city has a blanket or blanket easement ordinance over this entire property for utility easement," Pulley said, adding the easement was granted to the city in the 1970s and that "the city and developer does not need the blanket easement. We can acquire the necessary easements as this develop and as needed." The mayor then called for a motion; the council moved, seconded and approved the ordinances on voice votes.
The first ordinance (Bill 25 1 14) vacates the city's interest in part of a utility easement on Lot 2 of Starview Subdivision. The second ordinance (Bill 25 1 15) approves the record plat of Starview Groves, which subdivides a lot into two lots as part of the Starview Grove multifamily project. Planning and Zoning had recommended approval of related items earlier in the agenda.
Votes were taken by voice; the mayor announced each motion carried. No roll-call tally was read into the record for these two first readings; the council recorded the motions as approved.
What happens next: approval of the easement vacation and the record plat clears a municipal step that staff said will allow the developer and city to finalize targeted easements and proceed with development plans. Any future changes to the easement or additional required authorizations will return to the council as needed.
