Nunn trustees adopt 2024 building codes, approve permits and several small expenditures; North Weld water agreement remains under review

The Town of Nunn Board of Trustees adopted Ordinance 329 on April 16, 2026, updating the town's building and safety codes by reference to the International Code Council's 2024 editions. The board voted unanimously among present members to adopt the ordinance after a public hearing that produced no public comment.

The ordinance update is the meeting's highest-profile action: Trustee Smith moved to adopt Ordinance 329 and Trustee Kelly seconded. The roll-call votes recorded Trustees Smith, Kelly and Asher and Mayor Jordan Cable as voting yes; three trustees were recorded as absent. The code update brings the town's building, residential, plumbing, mechanical, fuel gas, existing building, property maintenance, swimming pool and energy conservation codes in line with the 2024 ICC model codes listed in the ordinance.

Beyond the code update, trustees approved two permit applications and a series of operating expenditures and proclamations. At the regular meeting the board approved a permit for a manufactured home at 1467 4th Street (applicants Frank and Maricela Rivas) and a permit for a detached garage at 895 7th Street. Both motions were moved by Trustee Smith and seconded by Trustee Kelly; roll-call votes were recorded as yes by Trustees Smith, Kelly and Asher and by Mayor Cable. The board also approved payment of outstanding bills totaling $68,659.20 and payroll totaling $47,790.36. Additional, smaller funding approvals recorded in the meeting included $750 for mobile data terminals (MDTs) for public safety, $1,500 for Microsoft 365, $4,000 for a cemetery storage container, $1,080.79 for truck repairs, and a $1,000 tree-purchase match tied to a tree grant. Trustees also adopted a Victims Advocate proclamation and an Arbor Day proclamation. All recorded motions listed Trustees Smith and Kelly as mover and seconder, and roll-call votes on these items showed the same voting pattern among present members.

Trustees discussed a proposed North Weld Water Services Agreement during the work session. Town attorney Matt Gould participated in that review and told the board that additional questions and clarifications were needed. Gould agreed to continue reviewing and amending the agreement and to provide the board with a copy before sending a draft to North Weld. The WSA review was paused at 7:12 p.m. to consider a permit item and resumed at 7:18 p.m.; no formal action on the WSA was taken during the meeting.

Procedural and personnel items concluded the meeting. Trustee Asher provided grant updates, Joseph Babiarz was sworn in as a new board member, and departing members Adam Smith and Lori McSwain were publicly thanked. The meeting adjourned at 8:32 p.m.

What happens next: The town attorney will continue to revise the North Weld Water Services Agreement and provide an amended draft to the board for review before any draft is forwarded to North Weld. The ordinance and funding approvals are recorded in the meeting minutes and will be implemented according to town procedures.
