Commission recommends approval of Lanier subdivision amendment with easement and mitigation conditions

The Montezuma County Planning and Zoning Commission recommended approval of a proposed 2‑lot subdivision amendment and rezoning to the J & J Lanier single‑lot development for a parcel at 27193 Road 10 in Pleasant View.

Planning staff told the panel the proposal would create one lot of about 3.5 acres and another roughly 6.5 acres, noted access and driveway permit requirements for County Road 10, and said Empire Electric and Montezuma Water Company can provide utilities. Staff also said the Dolores Water Conservancy District should be consulted for irrigation water rights on parcels smaller than 10 acres. "The applicants are proposing a 2 lot moderate subdivision with 1 lot roughly 3 and a half acres and the other partial roughly 6 and a half acres," planning staff said in findings distributed at the hearing.

Commissioners asked about overhead power lines and whether an access or utility easement exists; staff advised the surveyor should verify any existing access easement or dedicate one where necessary. The applicants (one of whom identified herself during the hearing as Jennifer Lanier) said they own the adjacent land and intend to sell the smaller parcel to family. Commissioners conditioned their recommendation on completion of a wildfire mitigation plan and establishing any required road and utility easements.

Committee member (speaker 2) moved to recommend approval to the Board of County Commissioners with those conditions; the motion was seconded and carried unanimously (5 ayes, 0 nays, 0 abstentions). Staff noted that some agency responses (weed department, wildfire partners) were still pending and should be completed prior to the BOCC hearing.

No public commenters spoke during the hearing. The recommendation and the required documentation will be forwarded to the Board of County Commissioners for final action.
