Planning staff stated the parcel is about 19.9 acres, accessed from County Road 21, with a 4‑inch Montezuma Water Company mainline on the east side of Road 21 and septic service to be handled through a health‑department permit. Staff said the local fire district requires a snow hydrant and Wildfire Adaptive Partners recommended a wildfire mitigation plan. "The applicant is proposing a 2 lot moderate subdivision on their just under 20 acre parcel," planning staff said, summarizing agency findings and outstanding items.
The applicant said survey work and an easement discussion led them to propose a 40‑foot driveway easement (rather than a 30‑foot easement) to provide utility and maintenance access because an existing overhead power pole sits roughly 36–37 feet from the property line. The applicant also said the existing small structure on the parcel is the owner's son’s garage and that they purchased the property in 2016; commissioners directed the applicant to confirm whether that structure meets setback requirements.
Commission discussion focused on three conditions: completion of a wildfire mitigation plan, verification (by survey) that the existing outbuilding meets required setbacks (or initiation of an after‑the‑fact variance), and that a future owner be made aware of the county land‑use code. Committee member (speaker 7) moved to recommend approval to the Board of County Commissioners with the wildfire mitigation plan as a condition; the motion was seconded and passed unanimously with five votes in favor and no nays or abstentions.
The commission closed the public hearing after no members of the public signed up to speak. The panel’s recommendation now goes to the Board of County Commissioners for final action.
