Developer seeks minor coastal setbacks; board hears pool-removal and revegetation plan

Marsden 35 LLC presented an application July 10 to construct a residence and patio at 35 East Dune Lane requiring small variances of roughly 1.9 feet and 1.1 feet from side-yard setbacks and a coastal-erosion-hazard-area permit for demolition and land-clearing work.
Attorney Carl Benacasa said the lot is undersized for the R-160 zoning district and the proposed residence is consistent in size with the prior home. He emphasized that an adjoining lot is owned by the applicant, reducing third-party impacts, and said the design team sought to minimize disturbance. The proposal includes removing an existing pool that lies seaward of the coastal erosion hazard line.
Village representative Billy Hajek said the pool removal requires a DEC/permit-level authorization for disturbance in the coastal hazard area and noted that the applicant submitted a revegetation plan using beach grass, which he described as appropriate. Benacasa said buttresses and a small terrace require relief of 1.93 feet and 1.12 feet respectively; board members indicated they had heard enough and closed the hearing.
The board did not enter a determination at the July 10 meeting; follow-up will be administrative and subject to coastal-permit requirements.
