Labette County canvassers select Jeremy James for Labette City Council seat after tie-breaker error

At a Nov. 18 special session, the Labette County Board of Canvassers authorized County Counselor Brian K. Johnson to draw a replacement name to correct a tie-breaker error; the draw produced Jeremy James for Position Four. The motion to allow the draw passed 3-0.
Chairman Vincent B. Schibi of the Labette County Board of Commissioners convened a special session at 9:01 a.m. on Nov. 18, 2025, and recessed the commissioners to hold the Board of Canvassers to correct a tie-breaker error from the Nov. 17 canvass of the Nov. 4 general election.
The board reported that James Smith had been listed as chosen for Position Four on the Labette City Council but had only three votes and therefore was not eligible under the county’s canvass findings. Two other candidates, Jessica Preble and Jeremy James, each had four votes and were eligible for the seat.
Commissioner Terry Weidert moved to authorize County Counselor Brian K. Johnson to draw a replacement name to resolve the tie; Commissioner Tom Barrett seconded the motion. The motion passed unanimously: Tom Barrett (Yes), Terry Weidert (Yes), Vincent B. Schibi (Yes). Following the authorized draw, County Counselor Brian K. Johnson drew Jeremy James, who will serve as the council member for Position Four.
County Clerk Gena Landis attested to the meeting record. Chairman Schibi adjourned the Board of Canvassers at 9:02 a.m., reconvened the Board of County Commissioners and adjourned the special session at 9:03 a.m. The board set its next meeting for 9:00 a.m. Wednesday, Nov. 26, 2025.
The action taken at this special session was procedural: the board corrected the canvass to reflect eligibility and used the authorized random draw to determine which eligible candidate would fill the seat. No other motions, amendments or controversies were recorded during the session.
