During a lengthy July 8 session the Municipal Code Enforcement Board debated whether its current per‑day fines are producing compliance and asked staff to present enforcement trends at a pre‑meeting on Aug. 12 at 5 p.m.
Board members said $25 per day is sometimes not impactful and discussed examples of repeated noncompliance where higher fines would better deter long‑running problems. Code staff members said they already exhaust many outreach and notice steps before cases reach the board and noted that for some issues — notably the Southwest Florida Water Management District’s Phase‑3 water order — staff must proceed directly to hearing without courtesy warnings.
Board members requested that staff bring a short presentation showing the number and types of cases handled, rates of voluntary compliance, and examples of repeat offenders so the board can consider a more tailored fine schedule. The board voted to hold a 5 p.m. work session before the Aug. 12 hearing to review those data and discuss a possible update to fine levels and enforcement guidance.
Next steps: staff will prepare data and trend charts for the Aug. 12 pre‑meeting. The board asked staff to highlight repeat violations, lien outcomes and the staff workload that precedes formal hearings.
