"I do struggle to release those guys," the council member said, adding that it would be a shame if the property remained neglected. Staff and the chair countered that the release allows the city to put the property back on the market and seek another developer who could complete the project.
Council discussion noted both the cost of pursuing enforcement and the potential benefits of enabling new development. Following debate, the council adopted the settlement by roll-call vote; the transcript records at least one dissenting vote. Staff said the release contractually ends the old development agreement and preserves the city's ability to pursue new arrangements for the parcel.
Councilors asked staff to ensure the city retains standard property maintenance and code enforcement remedies for the site and to document how future negotiation options would proceed. The action concluded the current legal relationship with the developer but did not itself authorize a new development agreement.
