Planning commission backs removing transfer restriction for animal hospital property

The Shawnee County Planning Commission voted unanimously to recommend removing a decades-old restriction that limited ownership transfer for a conditional use permit covering an animal hospital at 4144 Southeast 45th Street in Tecumseh Township.

Staff told the commission the request, filed as SP 87E, asks that Condition 2 of Resolution 8123 — adopted Aug. 13, 1980 — be removed so the special use permit would not be tied to the original owner. The parcel is about 5.18 acres and staff said no letters of objection were received from the 1,000-foot notices mailed to neighbors. The planning staff recommended approval.

During discussion, commissioners asked about the original intent of the ownership restriction. Staff said recent practice has not included such transfer limitations and the county’s modern approach has been to allow ownership changes without reapproval when the use remains the same. One commissioner noted the historical circumstance that the original doctor both ran the animal hospital and lived on the property, which likely informed the initial restriction.

Applicant representative Dave Mahon (address provided during the hearing) said the owner intends to sell the entire property and keep the veterinary practice as a tenant under an existing lease, which reportedly has more than four years remaining.

A commissioner moved to approve the staff recommendation; the motion was seconded and the vote to recommend approval was unanimous. The planning commission record indicates the item will be heard by the Board of County Commissioners on Thursday, Aug. 13.

The planning commission’s action is a recommendation; the Board of County Commissioners will take the final vote at its August hearing.
