Afton hears Terra Power MOU details and hears Supreme Court ruling favorable to town

Town Attorney Brandon Taylor briefed the Afton Town Council on Jan. 14 about two developments related to the region’s economic and legal landscape.
Taylor said the county encouraged Afton to engage with Terra Power’s initiative in Kemmerer after data showed a portion of Terra Power’s workforce commuted from Afton. Afton signed a Memorandum of Understanding (MOU) for $450,000 to be disbursed over 69 months once the project begins; the town’s payments are conditioned on project initiation.
Taylor also reported a decision in Sorenson‑Twiss v. Town of Afton: the Wyoming Supreme Court upheld the district court’s ruling in favor of the town in a 4–1 decision (Justice Fenn dissented). The decision was presented to the council as final and not contested during the meeting.
Taylor encouraged the council to coordinate with county staff on septic‑system and pre‑treatment planning and raised air‑traffic items as additional coordination areas. The council did not take formal action on the MOU at the Jan. 14 meeting beyond receiving the update; the MOU’s financial commitments are contingent on the Terra Power project and future milestones.
