Grottoes council approves nontransferable short-term rental permit at 407 14th Street after resident objects

The Grottoes Town Council on Jan. 12 approved a nontransferable conditional use permit for a short-term rental at 407 14th Street following a joint public hearing in which a resident raised concerns about whether the application process complied with local code.
A resident, Glamour Sullivan, told the council she opposed the permit and cited Grottoes code "100-108, permit procedure C.12," saying that when ownership changes "any conditional use permit for the property shall expire" and that the planning commission had not submitted a required report within 60 days. Sullivan also said a required property management plan and a local emergency contact list were missing from the application and that there was no indication the zoning administrator had determined a maximum occupant count for the property.
Town manager Kyle O'Brien responded that "between myself and the zoning administrator, we feel confident that all the procedures have been followed," and reminded the council that it had broad authority to accept planning commission recommendations or impose conditions.
Councilwoman McColl moved to approve a nontransferable conditional use permit for 407 14th Street for a short-term rental and said she was not including the planning commission's recommendation in her motion. The motion was seconded and carried unanimously.
The permit's nontransferable language means the conditional use runs with the approved owner and does not automatically transfer to a new owner on sale. The resident who spoke urged the planning commission and council to ensure the town's procedures and posting requirements under the code and the Virginia Freedom of Information Act were followed before permits were finalized.
The council did not record additional conditions in its motion beyond the nontransferable restriction. The town manager said staff and the zoning administrator would continue to handle compliance and follow-up as necessary.
