Mukwonago board approves right-of-way vacation and easement to extend Marsh View Drive

The Village of Mukwonago Board approved a resolution May 6 to vacate a portion of the Marsh View Drive right-of-way and accepted an easement to let the municipality begin construction on a planned extension of Marsh View Drive.

Village attorney Nathan Bayer said the portion targeted in the resolution is an unused, wider strip at the end of Marsh View Drive that would be narrowed so the road can be extended and tied into a private roadway located just west of the existing dead end. "It essentially just reverts to the joining property owner," Bayer said, adding that the easement "gives us the ability to do everything we need to make that Marsh View Drive extension and connect it with the private road."

The easement offered by the Glen of Mukwonago Condominium Association will allow the village to start work while the condominium association and the village complete the permanent transfer of property interests. Administrator (title only in transcript) told the board that obtaining 100% of HOA signatures for a permanent property transfer would take additional time and that the easement was the practical way to begin construction sooner.

A motion to adopt the resolution to vacate the right-of-way and a separate motion to approve the easement agreement were made, seconded and approved by voice vote; the chair declared both motions carried.

Next steps noted by staff include finalizing easement paperwork and coordinating construction plans with public works and the village engineer. No public testimony opposing the actions was recorded in the meeting transcript.
