County reviews counteroffer for Victor pump station and considers eminent-domain options to clear title

County staff reported that the Victor Improvement Club returned a $46,000 counteroffer to a county offer of $32,100 for property tied to the Victor pump station, an amount that exceeds staff settlement authority and requires commission approval to proceed further.
The utilities director noted that resolving a cloud on title will be central to any settlement because a prior lease contains a clawback clause that could revert the property if its original conditions are not met. Staff said the cost of an appraisal and appraisal review would be roughly $7,000 and warned that pursuing condemnation would add legal and administrative expense.
“As we discussed, commissioners, we have another lease coming up in 2 years…so we’ll be wrangling with similar issues,” staff said, recommending that the board authorize further analysis and, if necessary, return with a recommended path (administrative settlement, appraisal and negotiation, or eminent-domain carve-out).
Commissioners asked staff to consult with the county attorney and return with options and cost estimates. No final action or vote was taken during the briefing.
