The Hornellsville Town Board voted unanimously on May 12 to join a Joint Defense Privilege and Cost Sharing Agreement with the Village of North Hornell, the County of Steuben and the Hornell City School District in litigation brought by 1 Bethesda Drive LLC in New York State Supreme Court, Steuben County (Index No. E2025-1059CV).
Robert Mauro moved and David Oakes seconded Resolution 73-2026, which states the town will be responsible for ten and three-tenths percent (10.3%) of the costs associated with the coordinated defense. The resolution directs the Town Supervisor to execute the agreement and related documents on behalf of the Town of Hornellsville. The measure passed by a 5-0 vote for Dan Broughton, James Giglio, Robert Mauro, David Oakes and Trisha Yanni.
Following that vote the board adjourned the public session and met in executive session under Public Officers Law Article 7, 105(1)(f) to discuss personnel/limited-disclosure matters; the board reported no action was taken in the closed session and reconvened before adjourning at 7:39 p.m.
