Tioga approves dam emergency plan; withholds $45,000 in liquidated damages from trail final payment

The City Commission on Aug. 4 approved an Emergency Action Plan (EAP) for the Tioga Dam and authorized a reduced final payment to a trail contractor after commissioners applied liquidated damages for schedule delays.
Josh Reiner of Moore Engineering asked the commission to approve the EAP for Tioga Dam; the commission approved the plan on a motion by Jaden Iverson, seconded by Steven Dye. Reiner also requested final payment on the Tioga Recreational Trail project in the full amount of $102,996.19; commissioners discussed a 45-day delay and cited a liquidated-damages rate of $1,000 per day. The commission approved pay request #4 to Bechtold Paving “less the liquidated damages of $45,000.00,” authorizing a final payment of $57,996.19.
Reiner said notices had been sent to homeowners about the softball field relocation and that approval for construction from FEMA is expected within a couple of weeks.
The EAP approval and the pay request were recorded as motions with roll-call votes. The record shows the commission approved the EAP and the adjusted pay request; the minutes list the roll-call Ayes for the pay request as Iverson, Dye and Ralston. No further amendments or appeals to the payment decision were recorded at the meeting.
