Planning staff presented an amended plat for Lot 1 (John Dallas and Kelly Jo Johnson) proposing abandonment of a 15-foot irrigation easement across the parcel. The application does not go to the planning commission and the board heard public comment before deciding.
Elena Johnson, who identified herself as a nearby resident affected by the request, said she and adjacent property owners agreed the physical irrigation pipe should remain in place until property sales or future commercial use, and asked for that understanding to be reflected in the record. "I just wanted to make it clear in this meeting that the pipe needs to stay on there until they actually sell it," Johnson said.
Applicant representative Buddy Holman (P and H LLC) described current irrigation arrangements and said neighbors have cooperated informally; he said removing the recorded easement primarily affects the recorded right to traverse the property and that the existing underground pipe has functioned for shared irrigation.
County staff and the county attorney clarified that abandoning the recorded easement removes the county's role and that private agreements about leaving pipe in place or irrigating are between property owners and are not enforceable by the county. The board moved to approve the amended plat based on findings of fact and the motion passed unanimously among present commissioners.
The board's approval abandons the public record easement as requested; affected neighbors were advised to document and record any private maintenance or access agreements if they wish those arrangements to be enforceable.
