Victoria council grants Floyd’s Bar temporary noise permits but conditions future dates on compliance

The City of Victoria council on July 13 approved temporary noise permits allowing Floyd’s Bar to host amplified outdoor music until 11 p.m. on specified summer dates, but tied the remaining dates to compliance on the first approved night.
Community and Economic Development Director Jen Brewington told the council the city recently amended its code (chapter 12, article 2) to set 10 p.m. as a standard end time for amplified outdoor music in the Central Business District and to require council approval for extensions. Floyd’s applied for temporary permits to extend outdoor music to 11 p.m. on multiple weekend dates in July and August, Brewington said.
Two residents who live near the downtown venue told the council they have continued problems. "They played until quarter after 11 last Saturday," said James Robling, who gave his address for the record. "The music is much better than it was for noisewise, but … Sundays I cannot be outside at my residence. It is super loud, the cycles." Wayne Kesty said he and others reported violations to the sheriff’s office and had not seen changes in business practices since the new rule took effect.
Several council members said they support nightlife that brings people downtown but raised compliance and enforcement concerns. One council member recommended reducing an initial extension to 10:30 p.m. as a test and conditioning later 11 p.m. dates on compliance; another suggested granting the first date and making subsequent approvals contingent on adherence. City Attorney Vos confirmed council can grant permits and give staff authority to revoke remaining dates if violations occur without returning to council.
Mayor (speaker 1) moved to approve a temporary noise permit allowing amplified music until 11 p.m. for Floyd’s on Friday, July 17, with the condition that if Floyd’s violates the cutoff on July 17 the remainder of the dates in the application would be canceled and any remaining permits revoked. The motion passed; the record notes one audible nay and Council member Roberts recorded as dissenting.
The council directed staff to coordinate with the sheriff’s office on enforcement options and to consider sequential, conditional approvals for the remaining dates.
What’s next: The first extended night (July 17) will be a de‑facto compliance test; staff were authorized to cancel remaining dates if there is a violation on that night.
