Board to contact landowners about gated County Road 21 section; formal vacation possible

GIS staff identified a gated section of County Road 21 that may have been partially closed in 2020; commissioners directed staff to contact property owners to determine preferences and, if appropriate, start a road-vacation process to remove the segment from county maintenance rolls.
GIS staff Doug told the Board that a gate agreement and a partial closure recorded Jan. 7, 2020 appear to have left a section of County Road 21 south of B Road gated and effectively removed from routine county maintenance. Doug said the gate serves two adjacent agricultural properties and that the county should decide whether to formally vacate the right-of-way or reclassify the segment as a red-sign road.
"If that's been done, then that's the situation, and we at least need to take it off the highway user tax fund if it's not being maintained anymore," Doug said, recommending staff confirm records and property-owner signatures.
Commissioners agreed the first step is to contact the property owners to ascertain their preference for vacation or retention. Legal and property-easement questions were raised: board members noted section-line ownership and existing easements could affect whether the county must deed property or retain easements for ditches and utilities.
What comes next: Staff will reach out to the adjacent property owners, report their preferences to the board, and, if appropriate, begin the formal road-vacation process consistent with county and state procedures. The Board also discussed removing the segment from the highway-user-tax fund if the county ceases maintenance.
