Commission clears conditional use permit for 9465 Midland Boulevard but defers site-plan and storage decisions

His colleague (who identified themselves as "Admussen") and staff discussed whether the property is a continuing nonconforming use: Katie Sanders said the previous business had terminated its business license in February but that a new business-license packet was submitted in February and staff considered that sufficient to continue the commercial use while the CUP process proceeds.
City attorney Joe Bond and commissioners discussed limits on enlargement of nonconforming uses and whether outdoor storage or a shipping container should be allowed administratively or require a return to the commission. Bond amended exhibit language to contemplate overnight parking of one company vehicle with VIN documentation and to allow up to eight cars to be parked overnight. Commissioners expressed caution about permitting shipping containers and extensive outdoor storage without full review.
The commission voted to approve the conditional use permit with the stipulations discussed; the approval includes administrative authority to address certain site-plan items but defers final site-plan approval and any shipping-container or outdoor-storage approvals until revised plans and additional staff review are complete.
