Commission issues Certificates of Compliance and a negative RDA determination for 112 Powers Road after staff review

The Commission considered an after‑the‑fact reconstruction of a barn at 112 Powers Road and related historical enforcement records. Owner Kailia Starr said the barn—originally built to resemble a circa‑1986 structure—suffered smoke and water damage in a January fire and much of it was dismantled for reconstruction on the existing slab.
Coordinator Capone said she had issued a stop‑work order after construction began before filing. After inspecting the site she concluded the reconstruction reuses the original foundation, would not further encroach on the resource area, and recommended a Negative Determination of Applicability. The Commission voted unanimously to issue three Certificates of Compliance (DEP #301‑0168, #301‑0286, #301‑1076) and to approve Negative Determination #3 so the owners may resume work under the RDA.
Commissioners discussed the property’s enforcement history—including a 1988 Enforcement Order and a 1990 Order of Conditions recorded on the deed—and staff recommended issuing Certificates for the completed items to clear encumbrances where appropriate.
