Overland Board of Adjustment approves variances for 2636 Woodson Road

The Overland City Board of Adjustment on Jan. 14, 2026 approved a package of variances to allow a roofing contractor to operate an office at 2636 Woodson Road.
Community development staff told the board the site-plan review found the property did not meet current zoning for yard setbacks, screening and parking. "The site does not meet the current zoning code in relation to yard setbacks, screening, and landscape requirements, and parking," said Katie Sanders of the city's community development staff. The Planning and Zoning Commission had recommended approval of the conditional use permit and site plan contingent on variances outlined in the staff report.
Legal counsel Joseph Bohn told the board the building has a long history of use and likely predates local zoning. "This is essentially a like-for-like use," Bohn said, noting past operations and the building footprint leave little room for changes. The applicant, Andres Garcia, said the operation would be office-based for a roofing company and that "no materials will be stored on-site" and "everything that we order, it goes from our supplier to the customer's house." Garcia said the variances were sought so he could obtain an occupancy permit and use the existing structure.
The board approved the following variances by recorded voice votes from members present (Jeff O'Connell, Dan Kipper, Jay Fetch and John Seal): a front-yard setback reduced to 1 foot from the required 30 feet; a south side-yard setback of 0 feet and a north side-yard setback of 2 feet instead of the required 12 feet; waivers of frontage, interior and perimeter screening/landscaping requirements; and a reduction in required parking to four spaces from six for general office use. Each motion was made, seconded, and passed with affirmative votes recorded for the four members present.
Chair advised the applicant to coordinate with community development staff to pick up the approved variances. The board adjourned after completing the item.
The approvals are administrative variances under the city's zoning code; the variance approvals are valid for up to 180 days unless the applicant obtains a building permit and pursues construction or obtains a certificate of occupancy earlier. The board noted that under section 400.94 a concurring vote of four members is necessary for such decisions and that threshold was met.
No public comment opposing the variances was recorded in the hearing.
