Pat Hines said the applicant must provide a wetland validation survey and work with DEC on any stormwater improvements that encroach into the adjacent area; Hines also flagged the EAF note about potential bat habitat and said tree‑clearing restrictions could apply. The Board also directed the applicant to provide water and sewer plans and a City of Newburgh flow‑acceptance letter.
The applicant and Board discussed private‑road access on Pomarico Drive; Dates said the title opinion provided shows deeded access and that Colliers will submit a survey and plans for road improvements and utilities down Pomarico. "We will be conducting a full survey of the right‑of‑way limits, all the existing improvements," Dates said, and confirmed sewer and water connections will be extended to serve the site.
The Board voted to recirculate adjoiner notices and to declare intent to be lead agency, enabling SEQRA circulation (including DEC and DOT) and consultant review of the traffic study once submitted. Consultants emphasized that DEC wetland validation is a gating issue and that the City sewer‑flow letter will be required before final approvals.
