Planning board refers JJSK retail cannabis dispensary to county, schedules Dec. 5 public hearing

The Town of Newburgh Planning Board voted unanimously to refer JJSK Inc.'s site-plan application for a retail cannabis dispensary on South Plank Road to the Orange County Planning Department and to set a public hearing for Dec. 5, subject to the county response.
Joseph Saffioti, representing JJSK Inc., told the Planning Board that the Zoning Board of Appeals granted the variances the project needed and that the site plan has been revised to address technical comments, including restriping the parking and adding a dumpster enclosure. "All of the necessary variances were granted," Saffioti said.
The dispensary proposal at 165 South Plank Road (IB zone) had revisions to lighting, landscaping and parking; Saffioti said New York State DOT and the town highway superintendent were reviewing the Meadow Avenue/Route 52 entrance. Pat Hines of MHE Engineering told the board the project is a Type II action under SEQRA but recommended separate DOT review for the Route 52 access and confirmation that provided lighting is dark-sky compliant.
Board members pressed for operational details and site controls. John Ward asked about repaving thickness; Hines said a standard 1.5 inches is typical and the engineer will provide specifications. Tenant loading and dumpster arrangements were discussed with Angela Danosky, a neighboring tenant, who confirmed the deli currently loads through a side entrance; the applicant agreed to adjust landscaping to preserve that access.
Following staff recommendations that the board must submit its own referral to Orange County Planning, the board voted unanimously to refer the application. The board then voted unanimously to schedule a public hearing for Dec. 5, contingent on the county planning response arriving within the referral window; if the county response would miss the window the hearing would be set for the next feasible meeting date.
Next steps: the application will be sent to Orange County Planning for review; the town will confirm DOT comments on Route 52 access and MHE will review final engineering details before the public hearing is formally posted.
