Planning Board OKs accessory structures and ADU for 138 Pine Street with conditions

The Dover Planning Board voted 4-0 on June 29 to approve a Preliminary Site Plan Review (PSPR) for accessory structures at 138 Pine Street, filed by property owners Philip and Alicia Amato. The approval covers an in-ground pool with spa, a pool cabana with half bath, a barn/gym with storage and an 893-square-foot detached accessory dwelling unit (ADU).
Town Planner Melissa SantucciRozzi told the board the project was filed under Dover Zoning Bylaw §185-36 and §185-43 and that the property spans R-1 and R-2 districts but complies with dimensional requirements. Engineer Brian Nelson said the stormwater management system was approved by the Town Engineer and a landscape plan has been submitted; the Notice of Intent remains under Conservation Commission review.
The decision includes conditions that allow minor modifications to be approved administratively by the Planning Board Chair, require compliance with the Town's Stormwater Management and Erosion Controls (Chapter 159) and Board of Health permits, require any future lighting to meet dark-sky standards and not spill onto adjoining properties, and specify permitted uses for the accessory structures (the cabana and barn/gym shall not be used as dwelling units). The ADU is approved at 893 square feet, must have parking in the adjacent driveway, and "shall not be used as a short-term rental, as defined in Section 185-5 of the Zoning Bylaw." The decision also requires that the pool be filled by trucked private water and that all pool and spa water be dechlorinated prior to any discharge.
Abutters raised concerns about construction noise and the project team committed to provide contact information for the owner and site superintendent to address neighborhood concerns. Board members asked clarifying questions about location and landscaping; Mr. Nelson answered technical questions. The motion to approve the PSPR passed by roll call vote, 4-0-0.
