The commission’s attorney said the EDA was in “substantial form” but noted that “a few i’s to dot and t’s to cross” remained; the commission voted to approve the resolution so the developer could proceed without waiting an additional 30 days. Skyler said the developer has received a primary plat and is currently in the stage of having construction drawings reviewed, after which infrastructure and public improvements would be built, dedicated and the developer could move toward selling lots or building vertically.
The commission also approved professional services amendment number 5 for Haas and Associates to add professional surveying and exhibit work to establish legal descriptions and rights of way for roughly seven parcels associated with the South TIF connectivity improvement project. Ryan said the amendment includes an $11,500 allowance for surveying and exhibit preparation and an additional $5,500 added to the hourly services budget to cover coordination; a commissioner said the work is necessary to secure dedications for Meyer Drive, Tim Road and the Larkspur Lane extension.
Commission discussion noted complexities on a separate parcel at the south end of Town Center Drive that may be encumbered by an environmental restrictive covenant; staff said that parcel will require additional work with the Army Corps and is outside the immediate scope of the amendment.
The resolution and the PSA amendment passed by voice votes. The commission will complete final legal review of the EDA before execution; staff said advancing the EDA now helps maintain the development timeline.
Next steps: staff will complete the legal exhibits and coordinate final legal review of the EDA so construction work and public improvements can proceed.
