The North Beach Planning Commission on July 24 approved a development concept for the Shops North Beach project, a reduced-size commercial building, and attached conditions requiring the applicant to submit a Category 2 site plan that defines roof height, site category, setbacks and needed utility, curb and pedestrian details.
Planning staff said the proposed design is a scaled-back version of a plan the commission reviewed on June 27, 2024. The applicant described the earlier version as about 22,000 square feet but said the revised concept is "about 13,600 square feet," with a two-story presence on the Bay Avenue frontage, a roughly 3,500-square-foot restaurant on the first floor, two offices above and seven small retail shops of about 1,400 square feet each lining 5th Street.
The commission pressed the applicant on parking and setbacks. The applicant said there are about 16 parking spaces adjacent to the building and "about a 150" spaces in the lodge parking lot that will be available for patrons. Commissioners debated which street constitutes the front yard for setback rules and reviewed local code exceptions under section 5-104. Staff explained that, in commercial-to-commercial adjacencies, side or rear yard requirements may be reduced to zero if emergency access and maintenance are addressed and the reduction is approved by the planning commission.
Commissioners also discussed elevations and aesthetic treatments for the rear/loading side that faces the lodge parking lot. Several members recommended windows where feasible and suggested murals or other treatments for blank walls to better integrate the building with the Chesapeake Avenue approach.
Height and ornamental features were also considered. The commission reviewed the W2-zone 50-foot maximum height limit and whether the proposed cupola would count toward that limit. Staff noted the ordinance exempts roof ornamentation such as cupolas from maximum building height calculations, but commissioners requested the applicant clearly define the base roof ridge and the ornamental element on the Category 2 elevation drawings.
Chair recommended approving the development concept with a note that the applicant must comply with section 5-104 and provide required Category 2 materials (utilities, stormwater, parking, curb/gutter and walkways). The commission moved to approve the current application dated 07/24/2025 with stipulations that the subsequent Category 2 site plan define roof height and decorative pieces, site category and setbacks, and demonstrate compliance with the Category 2 site-plan requirements (6-6202). The motion was seconded and ayes were recorded; the approval was recorded as superseding the prior 06/27/2024 approval.
Next steps: the applicant will return with a full Category 2 site plan that includes precise setback measurements, curbline overlays, utility layouts, stormwater plans and elevation drawings; the commission said it will review those materials for compliance with the conditions set tonight.
