Paul Sexton appeared at the April 9 Town Council meeting to request a variance for 10223 Summit Avenue. Sexton told the council the original survey was incorrect and the encroachment (approximately six to eight inches into the ten‑foot side-yard setback) was discovered after a foundation was poured when a later survey company performed a wall check.
Leslie Olson provided a clarification on when the town’s side-yard setbacks changed from eight feet to ten feet. Council members agreed the lot’s peculiarity supported a variance in this instance, and the council instructed staff to prepare a resolution in support of the variance for consideration at the May 7, 2025 council meeting.
No final ordinance or formal vote on the variance was recorded in the meeting minutes; the resolution will appear on the May 7 agenda for formal action.
