Council schedules joint hearing on DEQ zoning changes and discusses adding civil penalties to zoning code

The Clifton Town Council on Oct. 6 set a joint public hearing with the Planning Commission for Nov. 4, 2020 at 7:30 p.m. to solicit public comment on proposed zoning-code changes required by the Virginia Department of Environmental Quality related to the Town Code, chapter 11 (Chesapeake Bay Preservation Ordinance).
Mayor Hollaway moved to set the joint public hearing; Councilmember Poe seconded and the motion passed by poll, 5-0. The Clerk was directed to advertise the hearing as required by law.
The meeting materials included a draft of the town’s zoning-enforcement provisions (Article XVII, Secs. 78-170 through 78-170.5) describing enforcement duties, notice requirements, types of violations and a schedule of civil penalties (initial penalty $200, $500 for additional violations, cumulative provisions and criminal referral thresholds). Councilmembers discussed adding a civil-penalty option to the zoning ordinance; the proposal was introduced and generally discussed during the Planning Commission report. The council noted that an update with additional details will be provided at the November meeting and that the Planning Commission had recommended holding the public hearing as soon as possible for DEQ-required language changes.
No final ordinance change was adopted Oct. 6; the joint hearing will be the next formal step for public input and possible adoption following statutory notice and comment requirements.
