Mahwah board approves variance for homeowner to replace deck with covered patio

The Township of Mahwah Board of Adjustment approved a 'C' variance on March 18 allowing homeowner William Davis to remove an existing covered deck and replace it with a larger covered patio at 30 Kiersted Place.
Acting Chairman Mr. Lockwood outlined the application and said the proposed work would enhance the property. Mr. Davis, sworn in for the hearing, said the existing deck had deteriorated and the new patio (reported in the record as 312 square feet) is intended to improve outdoor usability. Board member Mr. Kasparian said a smaller footprint would have been preferable.
Township Engineer Michael J. Kelly asked about basement egress; Mr. Davis said an egress window is intended to be installed. Attorney John Conte reviewed conditions of approval and the application notice: the project requires a Soil Movement Permit Application, the basement must have proper egress, and there shall be no bedroom in the basement as a condition of approval.
A motion to approve the variances was made by Mr. Taylor and seconded by Mr. Kasparian. The roll call vote recorded aye votes by Mr. Kasparian, Mr. Lockwood, Mr. Serna and Mr. Taylor; the transcript text also contains an inconsistent numeric tally in the minutes (see audit). The board approved the application with the conditions stated above.
The public hearing was closed before the work session, and the board moved from deliberation to the vote. The meeting adjourned at 8:12 p.m.
