The Middletown Zoning Board of Appeals voted to approve a variance allowing a 2,800-square-foot standalone warehouse to encroach 13 feet into the 75-foot front‑yard setback at 175 Industrial Park Road.
Applicant representative George Waugh told the board the property's wetlands and watercourses significantly reduce usable land and that Connecticut law supports granting a variance where topography creates a hardship: "The topography of his site requires the variance," Waugh said, arguing that the narrow encroachment (about 17 percent of the 75-foot setback) is minimal and does not alter the industrial nature of the neighborhood.
Owner (identified in the record) described site constraints that would make moving the building back impractical, including existing parking, drainage patterns and sanitary easements. Town staff confirmed the road's wide right-of-way makes the effective distance from the curb to the proposed building larger than the setback measured from the property line and described the 13-foot reduction as "fairly insignificant."
After closing the public hearing with no speakers, a board member moved to approve the variance; the motion carried. Staff advised the applicant that a site plan filing will be required before zoning approval is final.
