Code Ann. § 73-1-19 and the Board lacks authority to waive that statutory requirement. Michael J. Wolf, who submitted the request, addressed the Board to provide additional context before the Board moved into executive session to discuss the enforcement-related matter.
On a motion by Board member Larry Bishop, seconded by Board member Leigh Jaunsen, the Board entered executive session. After returning from executive session (with Mr. Wolf not rejoining the meeting), Mr. Bishop moved, and Ms. Jaunsen seconded, a motion to deny the business-name request; the motion passed unanimously.
The minutes record that Messrs. Leon H. Rittenberg III and Roland F. "Skipper" Samson III were present as guests and departed during the executive-session portion of the meeting; Mr. Wolf did not return. The Board did not record any alternative remedy or waiver; the denial was entered as the Board's action in executive session.
The Board took no further public action on the request at the March 2 meeting.
