Town attorney instructs council not to comment on ongoing CBDG-related investigation

During the Mayor's report the council was informed that a matter related to the CBDG housing grant application has been turned over to the county sheriff for investigation. Town Attorney McGill told the council the initial report is public information but that when an investigation begins the matter becomes confidential under the Criminal Justice Information Act.
"Once it is under investigation it is under the Criminal Justice Information Act; it is confidential," Attorney McGill said, and she urged council members and town employees not to discuss the matter. She advised that, if the matter later produces public charges, the council should respond with "no comment" until legal processes proceed. McGill said any subsequent formal charging would be handled by the County Attorney and that council discussion of litigation would, if appropriate, occur in executive session.
The council did not report charges or name any individuals during the Nov. 19 meeting; the attorney's remarks were an instruction about confidentiality and handling of inquiries.
