After debate over scale, Newburgh ZBA approves amended accessory building with lower height and reduced depth

Richard and Marissa Cavellero sought permission on Oct. 24 to build a large detached accessory building at 11 Copper Rock Road to store vehicles and household items. The requested structure initially approached 36-by-40 feet and roughly 25 feet high, which several board members and at least one neighbor said would be out of character for the subdivision.
Board members pressed the applicants on scale, neighborhood precedent and practical impacts; Code Compliance and the chair flagged the potential for the structure to be used as habitable or commercial space if left at greater height. During the hearing the Cavelleros agreed to lower the peak and shorten the depth. The applicant offered an amended plan roughly 38 feet wide by 30 feet deep with a reduced peak height (about 20 feet, 2 3/4 inches). The Board approved the amended application unanimously, and members recorded a condition that the structure not be used as an automotive repair business.
Chair Scalzo asked the applicants to work with the Building Department on revised drawings and reminded them that engineered plans and permits will be required before construction.
Quote "I could live with that. 2, 2, 2," the applicant said when offered the slightly reduced dimensions during the hearing.
Outcome The Board voted to approve the amended application (motion: Mr. Masten; second: Ms. Rein; vote 5-0). The applicant will submit revised plans and follow standard Building Department permit procedures.
