Select Board schedules Jan. 28 public hearing on proposed "Regulatory Compliance Certificate"

The Tamworth Select Board announced a public hearing for Jan. 28 at 5:00 p.m. to consider a draft "Regulatory Compliance Certificate" that would require property owners to notify the town about certain improvements rather than rely on the current voluntary Building Notification Form.

Select Board member Lianne Prentice said the draft is intended to add no new zoning or oversight; instead it would require notification of improvements so the town can observe and enforce existing regulations (groundwater protection, subdivision rules and floodplain controls). Prentice and the Planning Board are working with the Town Attorney to ensure the certificate is legally adoptable.

Bruno Siniscalchi raised a concern that adopting the certificate could trigger reassessments and increased taxes when improvements are reported; Nolan confirmed that reported improvements could affect tax assessment and said the town will need to plan outreach so newcomers and long-time residents understand the process. Prentice said the board will host work sessions if the item is adopted to sort out education, fee schedules and enforcement procedures.

The Select Board encouraged residents to read the draft certificate and attend the Jan. 28 hearing with questions. If adopted by voters, the certificate’s implementation details (fees, outreach, work sessions) will be scheduled by the Select Board and town staff.
