Herndon updates zoning to align with Virginia Chesapeake Bay rules, limits tree removal in preservation areas

The Herndon Town Council adopted zoning text amendment ZOTA 25-006 on April 28 to align local Chapter 78 with recent Virginia Department of Environmental Quality guidance implementing Chesapeake Bay Preservation Act updates.
Zoning specialist Aaron Zolick explained the amendment requires resiliency assessments for non-exempt disturbances within Resource Protection Areas (RPAs) based on a 30-year timeframe, limits removal of mature trees in RPAs and Resource Management Areas (RMAs), and allows nature-based adaptation measures when they meet guidance criteria. The update also adjusts definitions and implements DEQ-required changes.
Zolick said the planning commission recommended approval at its March meeting and staff recommended adoption. No public commenters addressed the amendment during the hearing. Council voted to adopt the amendment on a roll-call vote recorded as six in favor with one absent.
The amendment tightens protections for stream buffers and adds a resiliency lens to future land-disturbing proposals in the town's preservation areas.
