South Daytona Special Master orders corrections, sets fines and compliance hearings for multiple properties

At a Special Master Code Enforcement hearing held at City Hall, Community Development Director Josh McEnany presented Case #26-000105 involving 3376 Country Manor Drive (owners Kenneth L. and Jean Y. Hartman). McEnany alleged storm-drainage and floodplain-management violations under International Property Maintenance Code Section 507.1 and the City of South Daytona Code of Ordinances (Article IX). William Ford was called as a witness, and respondent representative Colleen Miles of Land Development Resource Group provided testimony on behalf of the Hartmans. Based on the evidence and testimony, the Special Master found the property in violation and ordered the respondents to correct the violation on or before July 7, 2026, at 4:00 p.m. The order states that a fine of $150.00 per day will be imposed for each day the violation continues past that date, in addition to a $125 administrative fee. A compliance hearing to determine whether the violation has been corrected is set for July 9, 2026.
Code Compliance Officer Ben Elkinton presented Case #26-000106, alleging sanitation, accessory-structure and gate violations at 46 Bryan Cave Road (owner Jack L. Leopard III) under International Property Maintenance Code Sections 302.1, 302.7 and 304.19. The respondent did not attend the hearing. The Special Master found that the property is in violation of the cited code sections and ordered correction by July 7, 2026, at 4:00 p.m., with the same $150-per-day fine and $125 administrative fee applicable for noncompliance. A follow-up hearing on compliance is set for July 9, 2026.
In old business, Elkinton reported that Case #26-000022 (Premiere Care Group, 829 Carey Drive) had been found in violation for roof and drainage deficiencies (IPMC Section 304.7) at a May 14 hearing. Elkinton said the property owner has hired a contractor who has applied for a roof permit and asked for a continuance. Special Master Branz continued that case to the August 12, 2026 hearing at 9:00 a.m.
The Special Master opened the hearing at 9:00 a.m., Deputy City Clerk Becky Witte administered oaths to participants, and Special Master Branz approved the March 5, 2026 hearing minutes. The session adjourned at 10:02 a.m. The next Special Master hearing is scheduled for July 9, 2026.
