Special Master orders Hartman property to fix storm drainage, sets daily fine for noncompliance

Special Master Matthew Branz found the property at 3376 Country Manor Drive in South Daytona in violation of the city’s property-maintenance and floodplain-management codes and ordered the violation corrected by July 7, 2026 at 4:00 p.m.
The finding came during a June 18, 2026 Special Master Code Enforcement hearing after Community Development Director Josh McEnany presented evidence alleging breaches of the International Property Maintenance Code Section 507.1 (storm drainage) and South Daytona Code of Ordinances floodplain-management provisions. William Ford testified as a witness and respondent representatives with Land Development Resource Group, including Colleen Miles, appeared and provided testimony in the case.
“Drainage of roofs and paved areas, yards and courts, and other open areas on the premises shall not be discharged in a manner that creates a public nuisance,” the Special Master cited from the city’s adoption of the International Property Maintenance Code in finding a violation.
Special Master Branz ordered that the respondent correct the violation on or before July 7, 2026 at 4:00 p.m. He said that if the respondent fails to comply, “a fine of $150.00 per day will be imposed for each day the violation continues past the date as prescribed in addition to a $125 administrative fee.” A hearing to determine compliance was set for July 9, 2026.
The order is rendered under the Special Master’s authority to issue findings of fact and conclusions of law in quasi‑judicial code enforcement proceedings. The hearing record notes the property parcel as 633754-00-0080. No appeal was filed at the hearing; Special Master Branz reminded attendees that appeals require a verbatim record per Florida Statute section 286.0105.
The Special Master’s written order will specify the relief and any timelines; the compliance hearing on July 9 will determine whether fines are imposed.
