During its zoning public hearings the Fairhope City Council spent substantial time on proposed dimension tables, specifically impervious-area limits and related footnotes that would cap the percentage of a lot covered by impervious surfaces.
Planning staff explained the proposal and said a material coefficient table and an engineered-alternative pathway would accompany the ordinance to translate different paving and surfacing materials into an objective standard. "The term impervious area shall include, without limitation, sidewalks, driveways, parking, walks and patios unless such surfaces are constructed of materials that allow passage of water into the ground at a rate equal to the predeveloped condition," staff read from the draft footnote.
Multiple residents and one councilmember warned the draft thresholds could render many existing small lots nonconforming and urged an alternative that lets property owners seek engineered LID (low-impact development) solutions instead of a blunt retrofit requirement. "There's going to be a lot more people that are over the limit now," one commenter said, calling for a baseline documentation or grandfathering of existing conditions and a net-zero approach for new work.
Council direction and next steps: Staff agreed to extract the coefficient table, clarify what counts as pervious for common materials (e.g., pavers vs. compacted gravel), and to draft an implementation approach that includes an engineered exception and maintenance obligations rather than immediate retroactive enforcement. Several council members asked staff to present examples showing how a given parcel would fare under the proposed percentages and how an engineered solution would be permitted and enforced.
