Committee recommends denial for Muncaster Mill Road sewer request tied to unpermitted units

The Transportation and Environment Committee recommended denial on July 13 of a water-and-sewer category change request for a 2-acre RE2 property near Muncaster Mill Road in the Upper Rock Creek area.
Mr. Levchenko said the applicant sought sewer for an existing home and additional apartment units that are part of a separate legal case; staff and the county executive recommended denial because no policy exceptions apply and the subject parcel is not abutted by a sewer main. "For those reasons, the executive planning board and council staff recommend denial of this request," he said.
Tim Williamson and other staff noted there appear to be two additional structures built without permits and that how those structures connect to the existing septic system is being resolved in court. The committee agreed that permitting and legal resolution are separate processes and that the water-and-sewer policy does not support approving sewer service for unpermitted structures absent subdivision or other property changes.
The committee asked staff to include the denial recommendation in the July 28 resolution package.
