Tyngsborough conservation commission issues two permits, continues multiple hearings to July 28

The Tyngsborough Conservation Commission on July 14, 2026 approved a negative determination for replacement of a failed septic system at 1518 Canongate Road and granted a major stormwater management permit paired with a negative determination for a proposed 3,505-square-foot restaurant at 01620 Kendall Road.
Brian Pedro of Hancock Associates, who presented the Canongate Road repair plans, told the commission the Board of Health had reviewed and voted on the design and that the plans were ready for the commission’s RDA action. "We believe that everything is in line in terms of design, repair, and ready to reconstruct the system," Pedro said. The commission moved, seconded and approved a negative determination for that RDA.
Andy Plant of Bolar Engineering presented the Kendall Road site plan and stormwater design, describing three inlets feeding an infiltration basin sized to the two-year storm with minimal overflow in a 100-year event. Plant said impervious area changes associated with an accessible sidewalk were offset by reductions to a patio so there was no net increase. After discussion the commission voted to issue a negative determination for the Riverfront/RDA review and to grant a major stormwater management permit.
Several larger matters were continued to the commission’s next scheduled meeting on July 28 to allow the peer reviewer and applicants time to provide additional documentation and revised site plans. That list included the 137 Protector (Pawtucket) Boulevard proposal (DEP 3091028), the Otis Woods subdivision (25 Ingalls Road, DEP 3091039), the Landauf/Dunstable Road ANRAD (475501), and the Global Partners proposal for 95 & 99 Westford Road. Commissioners said the continuances were driven largely by outstanding peer-review comments, requests for clearer dock and footing schematics, survey re-flagging, and clarifications about stream and isolated-wetland delineations.
On the Landauf/Dunstable matter the commission heard a detailed peer-review briefing recommending that the applicant submit updated field-verified flagging, a revised WPA form listing exact linear feet to be confirmed, and additional documentation around potential vernal pools and interior intermittent streams. The applicant agreed to compile re-flagging and survey data for resubmission.
Procedurally, the commission completed its annual reorganization: members voted to retain Ed Derby as chair and Jeff Kablik as vice chair. The commission also noted that the town’s drought status remains at Level 3 (critical), and reminded residents that outdoor watering is restricted except as allowed from a lake or river.
The commission adjourned after moving the listed matters to July 28. The July 28 agenda will include the continued items and any materials submitted in response to peer reviews.
