At the May 27 Falcon Heights workshop, staff presented a revised Parkland Dedication Ordinance that adds clarifying language specifying that any privately owned open space accepted under the ordinance must be "for public park and recreation purposes." Linehan said any parkland dedicated under the ordinance would remain for the city's benefit and under Council discretion.
Councilmembers Mielke and Gustafson said the clarified language addressed prior concerns and appeared clearer. Councilmember May raised a new concern about the relationship between homeowners associations and subdivisions, warning that HOA-maintained open space—even if legally public via easement—could create equity and accessibility challenges if maintenance effectively depends on higher-income HOA members.
Linehan responded that a public easement provides legal protection against exclusion and that the Council retains the discretion to require full city ownership and maintenance of parks rather than accepting a public-private arrangement; he noted many implementation details would arise as specific developments are proposed and would fall to future councils to resolve.
Next steps: the Council reached consensus to place the Parkland Dedication Ordinance on the June 10 regular meeting agenda for formal consideration.
