Nick, a city staff member, explained to the Burlington City Council on July 13 a proposed public-improvement resolution that would authorize acquisition of property or a permanent easement at the Jefferson Street railroad crossing to allow necessary rail-safety improvements.
Nick said BNSF previously attempted to purchase the small parcel (about 173 square feet) next to the crossing but negotiations stalled. Because the Iowa DOT Section 130 railroad-improvement grant funding has scheduling requirements, the city would act as the acquiring authority under its eminent-domain powers so BNSF could receive a permanent easement and proceed with required crossing and curb-line work. Nick emphasized that appraisal and compensation processes are underway and that no city general-fund dollars would be used: the state Section 130 money would pay for purchase and construction activities.
Staff and council discussed the potential risk to the downtown quiet zone and to maintaining the crossing if the work does not proceed; one council member said he believed the city had little choice but to act to keep the crossing open and protect quiet-zone status. The council did not record a formal vote during the work session; staff said the item will appear for council consideration as part of the upcoming meeting cycle.
