Planning Board conditionally approves merger of Rocky Shores parcels, requires razing and recorded mortgagee consent

The Wolfeboro Planning Board conditionally approved on July 7 a voluntary lot merger between 49 and 51 Rocky Shores Road (Map/Lot 227-10 & 13), but added conditions that at least one of the two existing structures be razed and that notice of merger and any mortgagee consent be recorded in the Carroll County Registry of Deeds.
Anthony Jones of Jones & Beach Engineers presented the application, saying the owner intends to eliminate the lot line between a house and an accessory dwelling and that the owner "owns both lots free and clear." Chair Steve Webster asked whether the existing buildings would be razed; Mr. Jones said that was the plan. Roger Murray noted that board records suggested a Bank of America mortgage but said the bank had consented to the merger. Murray also pointed out a confusing 258-foot rear setback shown on one plan that should be removed to avoid future confusion.
Board members questioned whether both buildings could remain on the merged lot. Vaune Dugan said the board cannot create a new lot with two houses on it. The board and Mr. Jones determined that the structure listed as an accessory dwelling unit exceeds 900 square feet and therefore does not meet the ADU criteria; the board concluded the merger could be approved only if at least one existing building is razed. Chair Webster moved to conditionally approve the merger with conditions that the owner or authorized agent record the notice of merger and the mortgagee's consent in the Carroll County Registry of Deeds. Roger Murray amended the motion to add the condition that the two existing structures be razed; Doug Breskin seconded the amended motion. Roll-call vote was Nancy Wiley-yes, Vaune Dugan-yes, Rhonda Martin-yes, Chair Steve Webster-yes, Roger Murray-yes, Doug Breskin-yes. Motion passes (6-0-0).
The conditions require administrative follow-up: recording the notice of merger, recording mortgagee consent where applicable, and obtaining any required permits for razing structures. The board asked the applicant to correct plan notations (the rear setback figure) to avoid future confusion.
