Associate Planner Grey Shipman told council the change responds to recent state legislation that limits local governments' ability to require permits for minor modifications to existing wireless facilities. Shipman said the amendment removes the term "Site Improvement Permit," aligns the code with federal and state review timeframes, and requires providers making minor changes to submit a verification form attesting those changes qualify as "minor" under state and federal rules. Shipman said failing to meet statutorily required review timelines can result in an application being "deemed approved" or subject the city to legal challenge.
The amendment would also allow the Director of Community Development to refer potentially incompatible minor-modification applications to the Planning Commission rather than City Council, which staff said would make the public hearing and appeal process consistent across similar application types. The text adds the phrase "by means of a conditional use permit" to clarify the conditional use and appeal pathway in the Land Use & Development Code.
City Clerk Natalie Hoel confirmed required public notice was posted on the city website on April 24, 2026. Mayor Pro Tem Peter Padilla opened and closed the public hearing; no members of the public spoke.
Councilmember Ann Taddeo moved to approve the ordinance on first reading; Councilmember Chris Fiedler seconded. The motion passed 7'0to'00 with Mayor Mills and Councilmember Jim Snyder absent.
The ordinance was advanced on a unanimous vote; the Code changes are intended to speed routine maintenance and equipment swaps on existing wireless facilities while preserving appeal rights through the conditional use permit process.
