Hyde Park board approves amended stormwater easement for NRICIA project

The Hyde Park Town Board voted unanimously on July 6 to approve Resolution 76-1Of2026, authorizing the town supervisor to execute an amended and restated stormwater management facility inspection and maintenance easement agreement for the NRICIA project. The clerk recorded five Aye votes and the motion carried.
The amendment reflects changes made during a recent site-plan amendment and an updated Stormwater Pollution Prevention Plan (SWIP). A presenter for the applicant told the board the revised agreement updates references to the new plans and an expanded ground-lease area and "makes much more clear what the owner and tenant are responsible for versus when the town would need to step in if the owner or tenant fails to perform their obligations." The presenter said the agreement now states the easement "runs with the land" rather than with the lease term, and therefore the town will not be required to assume maintenance of the stormwater infrastructure after the lease.
Resident Carol Pickering asked the board to "explain in plain language the difference between the original resolution and the 1 that you are amending and hoping to get," saying some residents received materials late. Town staff and the applicant responded that the amendment updates acreage and plan references and clarifies maintenance responsibilities. A board member confirmed the change of acreage discussed during the meeting from 21 to 26 acres and reiterated that the tenant remains responsible after a 99-year term.
On inspections and enforcement, a town representative said the town will perform routine inspections during installation and periodic checks to ensure the facilities are functioning. The presenter added the operator will obtain an annual inspection from a certified engineer and the town "may have its engineer enter the site to do periodic inspections as it pleases." If deficiencies are found, the applicant will be notified and is expected to correct issues.
David Steinmetz, appearing for the applicant team, told the board a team member, Michael, had experienced a "serious event" and was hospitalized; Steinmetz said he was "pinch-hitting" for the applicant and that the team requested the special meeting because of perceived urgency to secure the amendment.
The clerk took a roll-call vote on Resolution 76-1Of2026; the clerk read the names of voting members and recorded Aye votes. Following the vote the board moved on to other business and adjourned. The board also confirmed a public hearing tied to IDA benefits for the project is scheduled for 9:30 a.m. the next morning.
