JPJR seeks to revive 11‑lot Rockwood subdivision; Board says resubmission required under updated DEC and tree rules

Mike Bodendorf of Hudson Land Design requested conditional final approval for an 11-lot subdivision on Rockwood Drive, noting the project previously received approvals in 2013 and 2018 but that those approvals lapsed.
Bodendorf said the team is prepared to post the required performance bond for stormwater infrastructure and is working on outstanding items including drainage easement documents and landscaping. Pat Hines informed the Board that because the prior approval lapsed, the application is treated as a new submission and must comply with the Town’s Tree Preservation Ordinance as well as the DEC’s updated stormwater rules and wetlands jurisdiction guidance. Hines warned that DEC staffing changes and the new regulations can make review time consuming.
The Board and the Town attorney advised the applicant to resubmit to address outstanding engineer comments, provide drainage easement materials and coordinate with Orange County Planning for the required referral before scheduling a public hearing. Bodendorf acknowledged the need to complete the offer of dedication and related legal documents for the drainage district and to post the parkland fee and performance bond when appropriate.
After discussing next steps, the Board closed the meeting at 8:02 p.m. No final approvals were granted; staff instructed the applicant to resubmit with updated technical documents and to work with Town counsel before proceeding to public hearing.
