Developer revises Brewer Road plan; wetlands buffer and SEQRA review highlighted

Lara Pruschki, the applicant’s representative from Engineering & Surveying Properties, told the Town of Newburgh Planning Board that the Brewer Road sketch plan has been revised to 156 multi-family units after removing two buildings and adding a story to the remaining structures.
Pruschki said the team is preparing a market study to support a senior-density bonus and submitted a DEC parcel jurisdiction determination in late January after the new DEC wetland regulations took effect. "Our interpretation of those new regulations were that this property meets the criteria to be under DEC's jurisdiction," she said, adding the plan now shows a 100-foot buffer around wetlands and revised stormwater areas.
The Board and staff pressed for details and next steps. Pat Hines of MH&E reiterated that the project is a Type 1 action under SEQRA, requiring coordinated review, and that a DEC wetlands validation and a DEC permit will be required if jurisdiction is confirmed. Hines also recommended sending updated adjoiner notices within a 500-foot radius to inform neighbors of the reduced unit count and the changes in height and layout.
Board members asked operational and design questions: David Dominick asked whether EV charging could be added to the parking plan; Lisa Carver asked where the 14 senior units would be grouped; John A. Ward confirmed the buildings would be 35 feet tall. Pruschki said the senior units would be located together in one building and that the project now provides 336 surface parking spaces and no individual garages.
The Planning Board did not take final action. Staff and board members said they will await the DEC jurisdictional determination, revisions to the plan to show improvements on adjacent tax lots, and the coordinated SEQRA materials before the Board considers the matter further.
Next steps: the applicant will complete the requested market study, await the DEC wetlands determination and permit outcome, update plan sheets and adjoiner notices, and return for subsequent review and any required environmental coordination.
