At its March 27 meeting the Town of Newburgh Zoning Board of Appeals approved area variances for Cerone Enterprises (Smith Avenue, Walden; Section 31; Block 3; Lot 1.2) to allow reduced lot area, lot depth and side-yard setbacks needed to build a single-family dwelling.
Kenneth Lytle, the applicant's representative, told the board revised plans for septic laterals and well placement would be submitted to demonstrate compliance with Orange County separation standards. Code Compliance confirmed a well permit for the downhill parcel has been issued and that Joe Mattina would review the revised septic/well layout.
The board closed the hearing, conducted the five-factor balancing test, and approved the variances by voice/roll call. The approval included an explicit condition that well locations meet proper setback requirements and that Code Compliance review and verify required separations before a building permit is issued.
Mr. Lytle was directed to submit the revised septic and well documents to the ZBA office for inclusion in the decision record; Mr. Mattina will review the final submissions as part of the permit process.
