"I did talk to the petitioner today, noting that there was concerns about the hours and whether 1:30 would be a reasonable time. They said they would be appreciative if that could be extended to 01:30AM," Trejo said. He noted liquor‑license rules and a corridor survey of restaurant hours on Olive Boulevard.
Commissioners discussed safety, noise and whether the change should apply only to drive‑through service after 11 p.m. One commissioner said the police had indicated no safety concerns and that limiting interior dining while allowing the drive‑through would address noise and disturbance. Another added: "I don't think it has an effect on us. They should be open whatever they wanna be open with," reflecting a view that corridor norms supported later hours.
A motion was made to authorize approval of the site plan change as described in the Department of Planning and Community Development memorandum dated May 7, 2026, and then amended on the floor to set the approved drive‑through closing time at 2:30 a.m. The commission approved the motion 4–0. Trejo said staff would prepare the written action and send it to the city council, which has the final say on the regulatory change.
The vote record on the motion lists the commissioners as approving; the commission noted a staff‑recommended condition that had referenced 1:30 a.m. but accepted the amended 2:30 a.m. limit in the action. The council will be informed of the change as part of the normal review process.
