Benson commissioners approve rezoning and comp-plan change for 866 Tarheel Road

The Benson Board of Commissioners voted Oct. 8 to recommend approval of a rezoning (RZ-2024-09) and a matching Comprehensive Land Use Map amendment (CP-2024-01) for roughly 6.45 acres at 866 Tarheel Road.
Interim Planning Director Paul Embler described the proposal as a change from Residential Agriculture (RA) to Neighborhood Business (B2), and said the request was intended to make the property more marketable after unsuccessful residential marketing efforts. "The Planning Board and staff of the Town both recommend approval of this rezoning request," Embler told the board.
Attorney Jack Mclamb, representing applicant Don Byrd and owner Golden Leaf LLC, said Byrd bought and cleaned up the property in 2021, added sediment controls and a drainage pond, and attempted to market it for residential building without success in 2022. "The purpose of the rezoning is to make it more marketable for some type of neighborhood business," Mclamb said.
No speakers opposed the change during the public hearing. The Board adopted a statement of consistency and recommended approval of RZ-2024-09 and approved the companion comp‑plan amendment, both by 6-0 votes.
Staff noted that the Town's Comprehensive Land Use Plan originally recommended medium-density residential for the site, so the actions include the formal plan amendment required when zoning and plan designations are changed.
